In a post called Just the Facts, Robert Malone has published the lawsuit that he’s filed against Peter and Ginger Breggin, America Out Loud, Dr. Jane Ruby and Red Voice Media, which includes Stew Peters. Demanding a trial by jury, he seeks “not less than $25M in compensatory damages”, “not less than $350,000 in punitive damages”, 6% interest pre-judgment going back to July 2022, and court costs. The charge is defamation by implication and insulting words.
I had never heard of the Breggins before this controversy, about which he’s posted several times. I’m a paid subscriber to Malone’s Substack, Who is Robert Malone? and am active in the comment threads. With the broad variety of topics he covers, from the vaccines to agriculture to journalism to geopolitics, there are few people I agree with more. And twice a week he posts cartoons! It’s been well worth the subscription cost and allows me to connect to a wonderfully informed and caring community.
And that community was very much divided over this lawsuit. The most outspoken person against it has been banned, and you need to be a paid subscriber to comment, so every person on the 600+ comment thread is a dedicated follower. In reading through the filing in order to sort out my own responses, there were many things that confused me. So I wanted to do a post that goes into each of my questions in depth, bringing whatever background I was able to find. I have no insider knowledge, so I’ll just be looking at Malone’s or his lawyer’s own words and applying logic. Let’s do this.
are insults and implications grounds for defamation?
I have no legal training, so this is an open-ended question, but it seems a very dangerous precedent if upheld. For instance, if I said Fauci was a monster, or just that he was a liar, could he sue me for defamation? Would I need to prove it was true or would he need to prove it was false? If I said that his policies against early treatment were responsible for the deaths of hundreds of thousands, would I be implying he had killed hundreds of thousands? Could he sue Robert F. Kennedy Jr. for every insulting implication in The Real Anthony Fauci, or would he need to prove that what RFK wrote was factually untrue?
The filing reads:
The gist of the defamatory statements and implications is that Dr. Malone lacks the character and is unfit to be a medical doctor and scientist. Defendants’ statements (describe in haec verba below) exposed Dr. Malone to public ridicule, scorn, and contempt, and severely prejudiced him in his profession and employment.
In this case, Dr. Malone seeks presumed damages, actual damages for injury to reputation (past and future), insult, pain and mental anguish (past and future), special damages, including lost income, career damage and impairment of future earnings capacity, and punitive damages as a result of Defendants’ statements and actions.
As some commenters noted, however, Malone isn’t a practicing medical doctor. His scientific employment was formerly with the NIH and DoD, specifically in biodefense research. He doesn’t have a current employer, from his statements, but only makes income from his writing and his horse farm. If I’m mistaken, please let me know. Has Malone potentially lost $25M in writing income and subscriptions? That makes no sense to me.
one man’s credentials is another’s defamation
To make the case that Malone is a credible and upstanding person, the filing cites his invention of mRNA vaccination, his DNA and RNA/mRNA patents, his 100 publications and 12,000 citations, his chairing of multiple HHS and DoD committees, his membership on NIH’s ACTIV, “which is tasked with managing clinical research for a variety of drug and antibody treatments for COVID-19.”
The second paragraph on his credentials states that his mission “as expressly disclosed on his website, is to ensure vaccine safety, make sure that children are protected, stop and/or limit harmful vaccine mandates, and identify and teach about life-saving treatments for COVID-19 and other pandemics. His goal is to save lives.”
In effect, everything that he believes will make him credible to the court is exactly what the Breggins point to as evidence that he’s not credible as a whistleblower against the vaccine in specific, and against the government mechanism in general. The credentials he gives the court include the same facts about himself that he cites as defamation by Dr. Jane Ruby—membership on NIH’s ACTIV, HHS and DoD connections, and chairing committees that procured billions in research grants.
The lawyer’s descriptions of the Breggins says nothing about their medical credentials, or 110 years of combined work to reform medical and pharmaceutical abuses, as I found out from their website. Peter’s international campaign against lobotomies closed down psychosurgeries and ended government funding for research facilities. His research forced electroshock companies to inform the FDA it caused brain damage. Together the Breggins ended a Congress-funded interagency program on “inner-city children” to find biological and genetic causes for their alleged propensity for violence.
In the 1990’s, Peter was the sole medical expert for reviewing discovery in 150 combined cases alleging suicide, murder and psychosis from Prozac. As the date for the trial neared, everyone in his house became progressively sicker until a plumber happened to find that someone had removed the chimneys from their oil burner and water heater. By their account, they have been threatened and penniless but state:
… we have been blessed with a feeling of being protected when we have decided to make a stand about something we deem to be of great importance in respect to human well-being and freedom… By our deeds, we have earned our enemies, and the good that has come from our work has confirmed our choice on how to live.
a jury of whose peers?
The filing gives this description instead:
Breggin and Ginger Breggin are citizens of New York. They are husband and wife. The Breggins own and operate a website, breggin.com, on which they publish and advertise materials supportive of their view that America “is being taken down by a pack of bloodthirsty predators—frenzied over feasting upon the carcass of our great nation.” The Breggins produce and publish radio and internet shows, which they use to broadcast false and defamatory statements to Virginia and elsewhere. The Breggins also help operate America Out Loud, a website dedicated to informing America “of the evil politics and machinations of the Marxist Left.” America Out Loud broadcast and published in Virginia the Breggins’ statements about Dr. Malone (described below).
This description of them leaves out all of their professional history and credentials, doesn’t mention that they have a books-worth of evidence leading up to this conclusion, and presents it in the most extreme language. In other words, it makes them seem crazy, along with every other conspiracy theorist who thinks the Great Reset is a global plot of depopulation. I’m sure that your average jury, who hasn’t been steeped in the research, would agree.
But perhaps this is better than the blurb on Dr. Jane Ruby who “claims that she is a medical professional and a pharmaceutical drug development expert with over 20 years of experience in regulatory processes for drug approval with the FDA and the EMA” and “boasts” 436,000 subscribers on Stew Peter’s Network, 108,000 followers on Telegram, and 17,000 followers on Gab. The filing continues:
Ruby uses her Internet show and social media accounts to broadcast false and defamatory statements into Virginia to subscribers and users who pay Ruby for her unlawful content. On October 3, 2022, for instance, Ruby republished false and defamatory statements about Dr. Malone in a 54:38 minute episode that she titled, “Overcoming Psychopaths and Global Tyranny”. [https://rumble.com/v1miuec-live-7pm-overcoming-psychopaths-and-global-tyranny.html]. Ruby and the Breggins know no bounds or decency. They attack and defame anyone and everyone who disagrees with their theories about a new world order and global predators. In this case, the Breggins and Ruby initiated a smear campaign against Dr. Malone because Dr. Malone supported the views of a Belgian psychologist named Mattias Desmet (“Desmet”).
And this for Stew Peters:
A bounty hunter (alleged) turned internet podcaster, Stew Peters (“Peters”) has accused Dr. Malone of being a “mass murderer” because Dr. Malone is an inventor of the mRNA technology that was used to create the COVID-19 “vaccines”. During a February 2, 2022 show broadcast and published by Red Voice Media in Virginia, Peters stated, “Dr. Malone: All of the time that you’re spending on these podcasts and TV shows, hours with Joe Rogan, even here on the Stew Peters show, are you spending any time in the lab inventing the reversal to the carnage that you helped to invent that is now destroying humanity and killing all kinds of unborn babies and such?”
Is it an insult to say the Drs. Breggins and Ruby “know no bounds or decency”? Could that statement, if believed by everyone reached by Dr. Malone and by those who might repeat it, hurt their medical practices and their standing as scientific witnesses in pharmaceutical liability cases? Can the statement that they “attack and defame anyone and everyone who disagrees with their theories about a new world order” be disproven? It’s a very broad accusation. If they have sincere and well-meaning dialogue with others who disagree with their conclusions, it seems that the filing is a form of defamation.

psychosis of the sheeple or psychos ruling the world?
Ten of the fourteen statements are about ideological differences regarding Mattias Desmet’s theory of mass formation, which Malone termed as mass formation psychosis. But no ideological difference or opinions should be considered defamation.
If I take the factual statements that can be proven or disproven, I have the following:
1. For five years ending in 2017 Malone managed $9.5B in gov't contracts.
2. He's a member of the NIH ACTIV.
3. He has connections / associations with the CIA/DoD community.
In Malone’s interview with Dr. Joseph Mercola, reprinted on Children’s Health Defense, he states:
I have historically worked with people who have been truly Deep State intelligence community. I have decades of experience in biodefense. I have been deep in the belly of the beast.
I have won literally billions of dollars for my clients in grants and contracts. I have managed hundreds of millions of dollars in grants and contracts in the vaccine space.
As study section chair or key study section member on many hundred-plus million-dollar contract reviews for typically the NIH [National Institutes of Health] … but also DOD [Department of Defense]. I have historically been deeply embedded in this whole enterprise. I know it upside down.
I understand this system. So, I think the concerns that I could be controlled opposition are valid. I think that it’s appropriate to acknowledge the basis for those concerns. Now, [those] concerns, I think, are refuted by my behaviors and actions.
After he explains a business partner who was ex-CIA and contacted him from Wuhan in 2019, he goes on to say:
So even if I was controlled opposition, that’s kind of irrelevant. The question is not who I am; the question is what is the information? Is it useful to you? Is it helping you to manage your own affairs, make conformed [sic] choices about vaccinating your children?
If so, I think that even if I was controlled opposition, I suspect that I’m fairly useful controlled opposition for those of us that are in this boat together of seeking truth.
Frankly, all of my contacts with the government now are destroyed. The colleagues that I used to communicate with regularly at the FDA will no longer take my call … I’ve dropped my contract with Defense Threat Reduction Agency.
As my friend points out, the discovery for this trial will be interesting. In the end, it hinges on whether Malone’s financial records, phone records, texts and email demonstrate that he has had no contact or funding from his past life. I don’t agree with Malone that the question of whether he’s controlled opposition is irrelevant. And even if he is useful, the question is ‘to whom?’

At heart, this is a question of whether this is about mere profits and greed or an agenda of depopulation. To give my answer, this is The Reset’s Three Agendas:

I’ve followed Dr. Peter Breggin for many years and think the world of him and his wife, Ginger. As you say, they’ve stood up to defend people against Big Pharma and government policies that are beyond harmful. Your take on this sounds right to me, and I appreciate your delving into this disturbing can of worms!
